GENERAL TERMS AND CONDITIONS OF USE

1 .BACKGROUND

Thank you for visiting the www.SpecsToGo.com, and any other website that we operate (to which we refer to herein, together with its sub-domains, content and services, as a Site). We are a leading online retail store and information Site for eyeglasses, contact lenses and related products. We offer a large selection of designer and private label frames and related eye care products, along with information designed to help consumers make the most efficient and effective purchasing decision. It is our wish that any visit in our Sites and the experience of any purchase through our Sites’ will be pleasurable as possible. By accessing our Sites and/or by clicking the “I Agree” or “OK” button, you expressly acknowledge and agree that you are entering into a legal agreement with New Vision Investments, Inc. and the companies within the its group, including subsidiaries, affiliates, and/or related companies (or, collectively, we, us or our), and have understood and agree to comply with, and be legally bound by, these General Terms and Conditions of Use (or these Terms and Conditions). You hereby waive any applicable rights to require an original (non-electronic) signature or delivery or retention of non-electronic records, to the extent not prohibited under applicable law. If you do not agree to be bound by these Terms and Conditions please do not access our Sites or make any purchases through our Sites.

We reserve the right, at our discretion, to modify these Terms and Conditions at any time and from time to time. Such change will be effective 10 days following the posting of the revised Terms and Conditions on the Site, and your continued access or use of the Site thereafter means your acceptance of any changes to these Terms and Conditions.

2 .ABILITY TO ACCEPT TERMS

Our Site(s) is not structured to attract children under the age of 13 years. If you are under 13 years please do not visit or use the Site. If you are between 13 and 18 years of age, then you must review these Terms and Conditions with your parent or guardian before visiting or using our Sites to make sure that you and your parent or guardian understand these Terms and Conditions and agree to them.

3. CUSTOMER ACCOUNT

During your use of our Sites and in order to use our Sites’ services, you may choose to create and account, or the Account, and by doing so you agree to provide accurate and complete personal information as required by the order page, or the Account Information, and to keep the Account Information current, accurate and complete. If you choose to register to our website, we may offer different options to create an Account, including:

(a) Online Registration Form: You may choose to complete and submit an online registration form. You will be asked to provide us with certain mandatory information such as your name and email address, and also a password that you will use to access your Account.

(b) Third Party Accounts: You may choose to create an Account by clicking on a “login with…” button that we display on our Sites for a designated third party service, or the Third Party Account, such as Facebook or Google. Doing so will enable you to link your Account and your Third Party Account. If you choose this option, then you will be required to approve the connection as well as the types of information (which may include Personal Information) that we will obtain from your Third Party Account and the types of activities that we may perform in connection with your Third Party Account. Please note that in order to use this option, you will need to have, and may need to be signed-in to, an existing Third Party Account.

You agree not to create an Account for anyone else or use the Account of another without their permission. You are solely responsible for the activity that occurs in your Account, and you must keep your Account password secure. You must notify us immediately of any breach of security or unauthorized use of your Account. As between you and us, you are solely responsible and liable for the activity that occurs in connection with your Account. If you wish to delete your Account you may send an email request to us at service@SpecsToGo.com. If you provide information that is untrue, inaccurate, not current or incomplete, or we have plausible suspicions that such information is inaccurate, incomplete or untrue, we reserve the right to suspend or terminate your Account and refuse your use of the Site, including, but not limited to, sales resulting from the site.

4. PRIVACY

We will use the Account Information and any additional personal information we may collect or obtain in connection with our Sites in accordance with our privacy policy(or our Privacy Policy). You agree that we may use personal information that you provide or make available to us in accordance with our Privacy Policy.

5. THIRD PARTY SOURCES AND CONTENT

Our Site enables you to view, access, link to, and use content from Third Party Sources (such content referred herein as Third Party Content) that are not owned or controlled by us. Third Party Source may be a third party website or service provider.

We are not affiliated with and have no control over any Third Party Sources. We do not assume any responsibility for the content, terms of use, privacy policies, actions or practices of, any Third Party Sources. Please read the terms of use and privacy policy of any Third Party Source that you interact with before you engage in any such activity.

We do not endorse any advertising, promotions, campaigns, products, services or other materials that are included in any Third Party Content or that is communicated to you from a Third Party Source.

By using our Site(s) you may be exposed to Third Party Content that is inaccurate, offensive, indecent, or objectionable. You always have the choice of deciding whether or not to interact with a Third Party Source or to view and use Third Party Content. Your interaction with a Third Party Source and your use of, and reliance upon, any Third Party Content is at your sole discretion and risk.

You are solely responsible and liable for your interaction with a Third Party Source. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you may have against us, and release us from any and all liability, arising from your use of and interaction on any Third Party Content and from your interaction with any Third Party Source. If you have any query or complaint regarding a Third Party Source or any Third Party Content, you agree to contact the Third Party Source directly.

6. USER SUBMISSIONS

Our Sites permits the hosting, sharing, posting, and publishing of content by you and other users (collectively, “User Submissions”). Your User Submissions may be posted to our Sites, used to send commercial marketing materials to you,  or otherwise be made publicly available. You understand that whether or not such User Submissions are published, we do not guarantee any confidentiality with respect to any User Submissions. You shall be solely responsible for your User Submissions and the consequences of posting or publishing them. We have complete discretion whether to publish your User Submissions and we reserve the right without further notice to you, to monitor, censor, edit, remove, delete, and/or remove any and all User Submissions at any time and for any reason.

You represent and warrant that you own or have the necessary rights and permissions to use and authorize us to use all Intellectual Property Rights (as defined below) in and to your User Submissions, and to enable inclusion and use thereof as contemplated by these Terms and Conditions. Intellectual Property Rights means any and all rights, titles and interests, whether foreign or domestic, in, under, and to any and all trade secrets, patents, copyrights, service marks, trademarks, know-how, or similar intellectual property rights, as well as any and all moral rights, rights of privacy, publicity and/or similar rights of any type under the laws or regulations of any governmental, regulatory, or judicial authority, foreign or domestic. You retain all of your ownership rights in and to your User Submissions.

Subject to these Terms and Conditions and to our Privacy Policy, by submitting User Submissions, you hereby grant us a worldwide, irrevocable, non-exclusive, royalty-free, perpetual, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions only in connection with our Sites, including without limitation for redistributing part or all of your User Submissions (and derivative works thereof), and you hereby waive any moral rights in your User Submissions, to the extent permitted by law. You also hereby grant each user and Third Party Source a non-exclusive right to use, copy, reproduce, distribute, disclose, prepare derivative works of, display and perform such User Submissions in accordance with these Terms and Conditions.

You understand and acknowledge that when accessing and using our Sites: (1) you will be exposed to User Submissions from a variety of sources, and that we are not responsible for the accuracy, correctness, usefulness, safety, or Intellectual Property Rights of, or relating to, such User Submissions; and (2) you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable. You hereby waive, any legal or equitable rights or remedies you may have against us with respect to the foregoing subsection (1) and (2) above.

We reserve the right to access, read, preserve, and disclose any User Submission or any other information that we obtain in connection with the Site(s) as we reasonably believe is necessary to: (1) satisfy any applicable law, regulation, legal process, subpoena or governmental request, (2) enforce these Terms of Use, including investigation of potential violations of it, (3) detect, prevent, or otherwise address fraud, security or technical issues, (4) respond to your user support requests, or (5) protect the rights, property or safety of us, our users or the public.

You agree that you will not send, display, post, submit, publish or transmit a User Submission that: (1) is unfair or deceptive under the consumer protection laws of any jurisdiction; (2) is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights; (3) creates a risk to a person’s safety, health, or property, creates a risk to public safety, health, or property, compromises national security, or interferes with an investigation by law enforcement; (4) impersonates another person; (5) promotes or involves illegal activities, terrorism, drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking; (6) is unlawful, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, gives rise to civil liability, violates any law, or is otherwise dishonest, inaccurate, inappropriate, malicious or fraudulent; (7) constitutes an unauthorized commercial communication; (8) contains the contact information or any personally identifiable information of any third party unless you have first obtained the express consent of said third party to include their contact information or personally identifiable information; and/or (9) breaches these Terms and Conditions.

7. CUSTOMER PURCHASES

Product purchases may be executed via PayPal (or other third party payment service provider that we make available for you to use via our Sites). If you choose to proceed with a purchase via PayPal or other third party payment service provider then you: (1) agree to review and be bound by PayPal’s or such other third party payment service providers’ terms of use and privacy policy; and (2) you acknowledge that you may need to hold, or register, an active PayPal account in order to complete a product purchase. We are not responsible or liable for any activities or conduct of PayPal (or such other third party payment service provider), and you agree to hold us harmless, and expressly release us, from any and all liability arising from or in connection with any products that are offered for sale and purchased via the Site.

8. CUSTOMER CONDUCT; OWNERSHIP

The (1) content on our Sites, including without limitation, the text, documents, articles, brochures, descriptions, products, software, graphics, photos, sounds, videos, interactive features, and services (or collectively, the Materials), (2) and User Submissions (or together with the Materials, the Content), and (3) the trademarks, service marks and logos contained therein (or the Marks), are our property and/or our licensors’ property and may be protected by applicable copyright or other intellectual property laws and treaties. All other brands and names (including third-party product names) are the property of their respective owners. You may not use the name SpecsToGo, SpecsToGo.com, the SpecsToGo logo or any other graphics or services terms or names that are our Marks or our affiliates’ Marks on any site without our express prior written consent.

You acknowledge that all Content is copyrighted as a collective work under applicable law, including, without limitation, the U.S. copyright laws, and we own a copyright in the selection, coordination, arrangement, and enhancement of such Content. If no specific restrictions are displayed, you may make copies of select portions of the Content, provided that the copies are made only for your personal, information and non-commercial use and that you do not alter or modify the Content in any way, and maintain any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. Except as provided in the preceding sentence or as permitted by the fair use privilege under the U.S. copyright laws (see e.g. 17 U.S.C. Section 107), you may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other proprietary right.

It is forbidden under these Terms and Conditions to engage in any activity that will restrict or inhibit other users from using our Sites. You shall not: (1) copy, distribute or modify any part of our Sites without our express prior written authorization; (2) use, modify, create derivative works of, transfer (by sale, resale, license, sublicense, download or otherwise), reproduce, distribute, display or disclose Content; (3) disrupt servers or networks connected to our Sites; (4) use or launch any automated system (including without limitation, “robots”, “spiders”, or otherwise) to access our Sites; (5) parse any content within our Sites or copying any source code for the purpose of mimicking the look and feel of our Sites; and/or (6) circumvent, disable or otherwise interfere with security-related features of our Sites or features that prevent or restrict use or copying of any content or that enforce limitations on use of our Sites.

9. PRODUCT DESCRIPTIONS

We have made every effort so that our Sites display the dimensions and colors of our products as accurately as possible. However, the colors you see in our products will depend on your monitor. We cannot guarantee that your monitor’s display of any color will be accurate. We do not warrant that the product descriptions are accurate, complete, reliable, current, or error-free. If a product offered by our Sites is not as described, your sole remedy is to return it unused and with the full contents in accordance with our return policy (see “Return Policy” below for additional information).

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DO NOT AND WILL NOT ACCEPT LIABILITY FOR ANY DIRECT, INDIRECT, PUNITIVE, EXEMPLARY, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR LOSSES OF ANY KIND OR FOR ANY LOSS OF DATA, REVENUE, PROFITS OR REPUTATION, ARISING UNDER THESE TERMS AND CONDITIONS OR OUT OF YOUR USE OF, OR INABILITY TO USE, OUT SITES, OR THAT ARE RELATED TO THE PURCHASE OF GOODS OR SERVICES FROM OUR SITES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITY, DAMAGES OR LOSSES.

11. OTHER RIGHTS

We reserve the right to monitor areas of our Sites electronically and may at our sole discretion use and/or disclose any data or communication of any kind.

We may terminate or suspend your account and your accessibility to all or part of our Sites, without prior notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party or us.

As customer service is the most important aspect of our business, we reserve the right to deny your purchase of any product or service if it is apparent that you intend to resell the products. In addition, we reserve the right to limit quantities of items purchased by each customer to protect us to these ends.

12. TERMINATION OF TERMS

These Terms and Conditions are effective until terminated by either party with no prior written notice. If you no longer agree to these Terms and Conditions, you must stop your use of and visit to our Sites. You agree that any termination of your access to the Site(s) may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or our Sites. Further, you agree that we shall not be liable to you or any third-party for any termination of your access to our Sites.

13. WARRANTY DISCLAIMERS

This section applies whether or not the services provided under our Sites are for payment. Applicable law may not allow the exclusion of certain warranties, so to that extent certain exclusions set forth herein may not apply.

OUR SITES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT, ENDORSE OR GUARANTEE ANY CONTENT THAT APPEARS IN A USER SUBMISSION, AND DOES NOT MAKE ANY REPRESENTATION OR WARRANTY WITH RESPECT TO, AND DISCLAIMS ALL LIABILITY FOR, ANY SUCH CONTENT.

YOU SPECIFICALLY ACKNOWLEDGE THAT WE SHALL NOT BE RESPONSIBLE FOR THE USER SUBMISSIONS OR CONDUCT (INCLUDING DEFAMATORY, OFFENSIVE, ILLEGAL, OR NEGLIGENT CONDUCT) OF ANY SITE USER AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

14. APPLICABLE LAW

We make no representation that the Content in our Sites is appropriate or available for use in other locations, and access to it from territories where its content is illegal or prohibited. Those who choose to access our Site from other locations do so at their own initiative and are responsible for compliance with applicable local laws. You may not use or export the Content in violation of U.S. export laws and regulations. Any claim relating to our Site, the services provided through our Sites or the Content (or a Claim) shall be governed by the internal laws of the State of North Carolina and the laws the United States of America applicable therein, without reference to any choice of law provisions. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in the state of North Carolina and irrevocably agree that all Claims may be heard in such court. You agree that a final judgment in any such action or proceeding shall be conclusive and may be enforced in other jurisdictions by suit on the judgment or in any other manner provided by law.

You agree to defend, indemnify and hold us, our affiliates, subsidiaries, related companies, and our and their respective officers, directors, employees, representatives, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney’s fees) arising from: (1) your use of, or inability to use, our Sites; (2) your User Submissions; or (3) your violation of these Terms.

16. SUBMITTED FEEDBACK

It is our desire and pleasure to hear from our customers and welcome your comments regarding our products, including our Sites. We request that you be specific in your comments on our services and products. If you send us comments, suggestions, ideas, materials, notes, drawings, concepts, or other information (to which we refer collectively, as Feedback), the Feedback shall be deemed, and shall remain, our property. None of the Feedback shall be subject to any obligation of confidence on our part, and we shall not be liable for any use or disclosure of any Feedback. Without limiting the foregoing, you agree that we shall exclusively own and hereby assign to us without compensation or further obligation all now known or hereafter existing rights to the Feedback of every kind and nature throughout the universe and shall be entitled to unrestricted use of the Feedback for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Feedback, including the right to publish on the Site(s) or elsewhere and to use the Feedback, including any suggestions, ideas, etc. contained herein.

PURCHASE POLICY

 

1. COUPONS AND DISCOUNTS

We aim to keep our Products as affordable as possible and often distribute coupons and coupon codes through various channels for that purpose. Please be aware that you are not permitted to combine coupons and coupon codes nor add them retroactively to your order.

2. ORDER PRODUCTION AND PROCESSING

Lack of information in orders may lead to delays in processing such orders. There may be cases in which we will be required to contact you in order to obtain additional information, and such inquiries may also delay the processing of the order. In any event, we shall make reasonable efforts to notify you with respect to any delays.

4. SHIPMENT AND DELIVERY

Orders will be delivered to the address that appears on your order within reasonable time from the completion of the production and the quality checks.

Orders are usually shipped within 10 days from the date of confirmation of payment; however, there may be delays due to external factors. The time of delivery can vary depending on the destination. Please note that additional local taxes may be applied to shipments to locations outside of the United States.

We shall not be liable for delays in shipment due to faults of the carrier, and therefore these delays will not result in refund of shipment cost, however, we will make reasonable efforts to assist you with respect to such delays in a timely manner.

When you place your order, you must choose shipping and delivery options. Standard shipping can take up to can take up to approximately 14 (fourteen) business days from the date of shipment. If you need your Product faster, you can upgrade to the Expedited or Express shipping option. Once the package is shipped from a SpecsToGo.com facility, it is no longer the responsibility of SpecsToGo.com but the responsibility of carrier.

Upgrading your shipment does not infer overnight delivery. Delivery times are based on estimation only and exclude the production and verification stages.

It is important that you enter your address correctly. If the shipment is addressed to a commercial entity (e.g., an office or a hotel), please make sure to indicate that your order is to be delivered to the commercial entity that is located at such address. Failure to input any part of your address will cause delays in shipments and increase the costs of the purchased Products. We will not refund or exchange products that were shipped to an inaccurate address as a result of missing details. Shipping claims should be addressed within 30 days from the date of the shipping.

 

5. RETURN POLICY

We do our best to make returns and exchanges as simple as possible.

We are confident that you will enjoy our eyeglasses. However, if you are not completely satisfied with your eyeglasses within the first 30 days after delivery, you are entitled to a refund, product exchange, or a 100% store credit. No questions asked and hassle-free.

In the event that eyeglasses are returned, it shall be returned in their unused, original and merchantable condition and in their original packaging, including all accessories such as case and cleaning cloth. Eyeglasses that have had third

We will offer you:

  • 100% money back guarantee or store credit (note that the refund does not include the cost of any shipping .
  • Product exchange of equal or lesser value.

A tracking number should be provided to us for all returned items. Exchanges, issuance of store credit and refunds will only be processed once the returned item(s) arrive at our facilities, and can be verified with a tracking number.

Refunds will be effected via the same method of payment used to order the Product (credit card, debit card, PayPal, etc.). Please allow up to 30 days from when we receive the item, for the credit to appear in your account. Keep in mind that some refunds may take over 30 days from the purchase date to be processed

Each item may be returned a single time, within 30 days after its delivery, for a 100% refund (as specified above), store credit or an equal-value exchange. The next return with respect to the same item will only be eligible for store credit or equal-value exchange. Every item originating from the same order may be returned up to 2 times in total.

Important Notes: 
*All store credits and exchanges are non-refundable.
*It is the customer’s responsibility to ship the item(s) back within 30 business days from receiving the item(s).  Return requests will not be processed after such time frames.
*Store credit is valid for 3 months from the date granted. The validity of store credit cannot be extended.
*Store credit may not be used in conjunction with certain coupons.
* A tracking number must be provided for all returned items.
* Each item is entitled to a one-time, no-questions-asked, return for either 100% refund or store credit (does not include the cost of any shipping) or product exchange of equal or lesser value.
* Returns can only be processed within 30 days of delivery, and are limited to 2 (two) per item. Please note that SpecsToGo.com reserves the right to require proof of error for an item returned more than once.

* All return settlement requests are final and irreversible. This does not include further offers of store credits or exchanges accepted via a verbal agreement after submission. Acceptance of said offers are final and irreversible as well.

6. EYEGLASSES MANUFACTURER’S WARRANTY

All frames have a 365-day manufacturer’s warranty. In the unlikely event that your frame breaks after the initial 30 days following delivery and within one year of your purchase, we will gladly provide you with a 50% store credit towards another pair of eyeglasses. Your store credit will be in the amount of 50% of the amount paid for the item; this does not include the shipping cost. The coverage does NOT include accidental damage from handling or damage from normal wear and wear nor from mounting of third party lenses.  Please note it is the customer’s responsibility to return the glasses and provide us with the return shipping tracking information. Furthermore, a picture of the damage to the item is required for the warranty to be activated.

7. LIMITED WARRANTY

The following are not covered under the  One-Year Coverage Warranty and/or the Glasses Manufacturer’s Warranty (referred to above): (1) DAMAGE FROM INTRODUCTION OF FOREIGN OBJECTS INTO THE EYEGLASSES, UNAUTHORIZED EYEGLASSES MODIFICATIONS OR ALTERATIONS; (2) FAILURE TO FOLLOW THE MANUFACTURER’S CLEAN AND CARE INSTRUCTIONS; (3) UNAUTHORIZED REPAIRS; (4) DAMAGE INCURRED DURING TRANSPORTATION; (5) DAMAGE FROM TAMPERING WITH ELEMENTS DESIGNED TO SECURE LENSES AND/OR ARMS; (6) EYEGLASSES THAT ARE LOST OR STOLEN; AND (7) EYE EXAMS OR OTHER MEDICAL EXPENSES ASSOCIATED WITH OBTAINING REPLACEMENT EYEWEAR.

OUR PRIVACY POLICY

We, at New Vision Investments, Inc. d/b/a/ SpecsToGo.com, respect the privacy of your personal information, and as such place every effort to ensure your information is protected and private.

This Privacy Policy describes how we use Personal Information (defined below) that we collect, receive and store about individuals in connection with the use of the website www.SpecsToGo.com , and any other related or affiliated websites (each, together with its sub-domains, content and services, a “Site”).

We do not ourselves host any of our Sites – all hosting is done by third party service providers that we engage. This means that data you provide us or that we collect from you (including any Personal Information) – as further described in this Privacy Policy – is hosted with such third party service providers on servers that they own or control. Regardless of where such third party service providers are located (and some are located in the US), their servers may be located anywhere in the world (including the US). Your data may even be replicated across multiple servers located in multiple countries. So please be aware that you are consenting to your data being transferred to various third party service providers around the world (including the US).

1. INTRODUCTION

This Privacy Policy explains our online information practices and the choices you can make about the way your Personal Information is collected and used in connection with our Sites. ”Personal Information” means any information that may be used, either alone or in combination with other information, to personally identify an individual, including, but not limited to, a first and last name, a personal profile, an email address, a home or other physical address, or other contact information. The Personal Information you provide will not be sold, rented, or traded to anyone. We will not to disclose your information to third-parties except as otherwise specified under this Privacy Policy, and except if such disclosure is required by governmental authorities or applicable laws.

3. CONSENT AND MODIFICATION

You are not required to provide us with any Personal Information, and by providing us with any Personal Information you hereby confirm that you are doing so at your own free will. By using our Sites, you consent to the terms and conditions of this Privacy Policy and to our collection, processing and sharing of Personal Information for the purposes set forth herein. If you do not agree to this Privacy Policy, please do not access or otherwise use our Sites. We reserve the right, at our discretion, to change this Privacy Policy at any time and from time to time. Such change will be effective 10 days following posting of the revised Privacy Policy on the Site, and your continued use of the Site thereafter means that you accept those changes.

4. WHAT KIND OF INFORMATION DO WE COLLECT AND HOW WE COLLECT IT?

We do not currently require you to provide Personal Information in order to have access to general information available on our Sites. But, we do receive and/or collect Personal Information from you in the following ways:

4.1. Account. During your use of our Sites and in order to use our Sites’ services, you may choose to create and account, or the Account, and by doing so you agree to provide accurate and complete personal information as required by the order page, or the Account Information, and to keep the Account Information current, accurate and complete. We may offer different options to create an Account, including:

(a) Online Registration Form: You may choose to complete and submit an online registration form. You will be asked to provide us with certain mandatory information such as your name and email address, and also a password that you will use to access your Account.

(b) Third Party Accounts: You may choose to create an Account by clicking on a “login with…” button that we display on our Sites for a designated third party service, or the Third Party Account, such as Facebook or Google. Doing so will enable you to link your Account and your Third Party Account. If you choose this option, then you will be required to approve the connection as well as the types of information (which may include Personal Information) that we will obtain from your Third Party Account and the types of activities that we may perform in connection with your Third Party Account. Please note that in order to use this option, you will need to have, and may need to be signed-in to, an existing Third Party Account.

4.2. ‘Contact Us’ Information. If you send us a “Contact Us” request, whether by submitting an online form that we make available or by sending an email to an email address that we display, you may be required to provide us with certain information such as your name and email address.

 

4.3. Share with Friends Service. Our Sites may enable you to invite your friends to use our Sites by sending them an invitation email or message. You may do so by: (1) using our Sites to send or post an invitation message via your Third Party Account; and/or (2) using our Sites to send an invitation email to your friend’s external email address (for example, a Gmail address). If you send or post an invitation message we may collect Personal Information about the recipient such as their email address or third party website account user name and id.

4.5. Location Data. We may provide certain location-based services, or Location Services, in connection with our Sites that are dependent on data related to the geographic location, or the Location Data, of your mobile or other device through which you are accessing our Sites. If you choose to participate in these Location Services, you agree that we may collect or obtain your Location Data. You should be able to use the settings on your mobile or other device to turn off location-sharing features.

4.6. Profile and photos. Some parts of our Sites may enable you to build a public profile in connection with your Account, or the Public Profile. Your Public Profile will include your name and other information that you choose to include in your Public Profile, such as your gender and a profile picture. In addition, our Sites may enable you to try different styles of glasses on an image of your face.

4.7. Purchases. Our Sites include the option to purchase certain products or services from us. If you choose to make a purchase we will require sufficient information from you to complete the transaction. Such information could include a credit card number and related account and billing information, invoice related information, and other data required to process the order. We may use the tools, software or services of third-party service providers to process transactions on our behalf, in which case you acknowledge and agree to review and be bound by the terms of use and privacy policy of said third-party service provider.

4.8. Log Files. We make use of log files. The information inside the log files includes internet protocol (IP) addresses, type of browser, internet service provider (ISP), date/time stamp, referring/exit pages, clicked pages and any other information that your browser may send to us. We will use such information to analyze trends, administer our Sites, track users’ movement around our Sites, and gather information.

4.9. Cookies and Other Tracking Technologies. Our Sites utilizes “cookies”, anonymous identifiers and other tracking technologies which enable us to provide you with information that is customized for you. A “cookie” is a small text file that may be used, for example, to collect information about activity on our Sites. Certain cookies and other technologies may serve to recall Personal Information, such as an IP address, previously indicated by a user. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser.

4.10. Analytics services. Our Site(s) may use the tools described below (the “Analytics Services”) to collect information about use of our Site(s), such as how often users visit our Site(s), what pages they visit when they do so, and what other sites they used prior to visiting our Site(s). We use the information we collect from the Analytics Services to maintain and improve our Site(s) and our products and services.

4.11. The Analytics services we use include:

Google Analytics. Our Site may use a tool called “Google Analytics”. We do not combine the information collected through the use of Google Analytics with Personal Information. Google’s ability to use and share information collected by Google Analytics about your visits to and use of our Site(s) is restricted by the Google Analytics Terms of Service, available at http://www.google.com/analytics/terms/us.html, and the Google Privacy Policy, available athttp://www.google.com/policies/privacy/. 5. Publicly Available Information

Your Public Profile and any content that you post on or via our Sites, or the User Submissions, may be publicly available to other users of our Sites, and may also be accessed and used by people off the Site. The notices and tools that we provide on our Site(s) are intended to inform you which information will be made publicly available. If you publish your contact information in any User Submissions or as part of your Public Profile, you may receive unsolicited messages from other users of the Site or the public. We, therefore, encourage you only to post information that you are sure you want to be accessible to anyone.

6. The Way We Use Personal Information

If you submit or we collect Personal Information through our Site(s), then we may use such Personal Information in the following ways, via any applicable communication channel, including email, SMS, etc.:

6.1. We will use your Personal Information to: (1) provide and improve our Sites, (2) to send you marketing and advertisement communications that we believe may be of interest to you; and (3) to identify and authenticate your access to the parts of our Site(s) that you are authorized to access.

6.2. We may use your designated email address to: (1) send you updates or news regarding our Sites and our products and services; and/or (2) respond to a “Contact Us” or administrative request (for example, to change your password).

6.3. If you choose to send your friend an invitation email or message we will use the contact information that you provide, or make available, to automatically send your friend an invitation email or message. Your name and email address may be included in the invitation email or message.

6.4. We may transfer your Personal Information to other companies within our group, including to our subsidiaries, affiliates, and/or related companies, for the purpose of storing, using or processing such information on our behalf. Such Personal Information may be transferred to other countries. We require that these parties agree to process such information in compliance with this Privacy Policy.

6.5. We may share your Personal Information with our third party service providers and partners, but only to assist us with our business operations and to provide our Sites’ services to you and other users. Such information may be transferred to other countries. We use commercially reasonable efforts to only engage or interact with third party service providers and partners that post a privacy policy governing their processing of Personal Information.

6.6. We may disclose your Personal Information or any information you submitted via our Site(s) if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (1) comply with any applicable law, regulation, legal process or governmental request; (2) enforce our General Terms and Condition of Use, including investigations of potential violations thereof; (3) detect, prevent, or otherwise address fraud or security issues; or (4) protect against harm to our rights, property or safety, and with respect to our users, yourself or the public.

7. Use of Anonymous Information.

Use of Anonymous Information. We may use Anonymous Information (as defined below) or disclose it to third party service providers in order to improve our Site(s) and enhance your experience with our Sites. We may also disclose Anonymous Information (with or without compensation) to third parties, including advertisers and partners. Anonymous Information means information which does not enable identification of an individual user, such as, aggregated information about the use of our Site

8. Opting Out

You may choose not to receive future promotional, advertising, or other Site -related emails from us by selecting an unsubscribe link at the bottom of each email that we send. Please note that even if you opt out of receiving the foregoing emails, we may still send you a response to any “Contact Us” request as well as administrative emails (for example, in connection with a password reset request) that are necessary to facilitate your use of our Site(s) and notifications regarding your orders.

9. Choice

At all times, you may choose whether or not to provide or disclose Personal Information. If you choose not to provide mandatory Personal Information, you may still visit parts of our Site(s) but you may be unable to access certain options, programs, offers, and services that involve our interaction with you.

10. Update information.

If you are a registered user of our Site(s), you can access and edit your Account Information online by clicking the “My Account” button on the Site. You may also have your personal information revised by sending us an email to service@SpecsToGo.com or by calling us via the contact information below.

11. Removing Personal Information.

Customers who supply us with their telephone numbers online will only receive telephone contact from us with information regarding orders they have placed online. You may also call our customer service at the phone number listed below or email us at service@SpecsToGo.com and we will remove your Personal Information.

12. Secured Network.

We take your Personal Information’s security very seriously. As such, we use Secure Socket Layer (SSL) technology, which creates an encrypted link between our web server and your browser, and provides a secured path of communication to ensure the information remains protected and private.

13. No Use of Ad Serving or Spyware.

Ad serving describes a technology that places ads on websites. Spyware is software which used for collecting information about users without their knowledge or prior their consent. Maintaining the security and privacy of your Personal Information is our highest priority. Thus, we do not partner with, or have any special relationships with any ad serving companies, and we categorically do not use spyware. Furthermore, we dedicate major efforts in order to ensure that our Sites and your Personal Information are secured, and that there is no spyware activity on our Sites.

14. Links to and Interaction with Third Party Products.

Our Sites may enable you to interact with or contain links to your Third Party Account and other third party websites that are not owned or controlled by us, or Third Party Services. We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services may collect Personal Information from you. Accordingly, we encourage you to read the terms and conditions and privacy policy of such Third Party Services that you choose to use or interact with.

15. Children’s Privacy

Our Sites is not structured to attract children under the age of 13 years. Accordingly, we do not intend to collect Personal Information from anyone we know to be under 13 years. If we learn that we have collected Personal Information from a child under 13 years, we will delete that information as quickly as possible. 16. Security

The security of your Personal Information is important to us. We strive to follow generally accepted industry practices, including the use of administrative, physical and technical safeguards, designed to protect the Personal Information submitted to us. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we endeavor to use reasonably acceptable means to protect your Personal Information, we cannot guarantee its absolute security or confidentiality. 17. Merger, Sale or Bankruptcy.

In the event that we are acquired by or merged with a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer or assign Personal Information in connection with the foregoing events.

18. California Privacy Rights.

California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to service@SpecsToGo.com. Please note that we are only required to respond to one request per customer each year.

19. Our California Do Not Track Notice.

We do not currently respond or take any action with respect to web browser “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third-party web sites or online services. We may allow third parties, such as companies that provide us with analytics tools, to collect Personal Information about an individual consumer’s online activities over time and across different web sites when a consumer uses our Sites.

20. Deletion of Content from California Residents. 
If you are a California resident under the age of 18 and a registered user, California Business and Professions Code Section 22581 permits you to remove content or Personal Information you have publicly posted. If you wish to remove such content or Personal Information and you specify which content or Personal Information you wish to be removed, we will do so in accordance with applicable law. Please be aware that after removal you will not be able to restore removed content. In addition, such removal does not ensure complete or comprehensive removal of the content or Personal Information you have posted and that there may be circumstances in which the law does not require us to enable removal of content.
